Terms of Service

Welcome to Travelear. These Terms of Service govern your access to and use of the Travelear mobile application and website. By creating an account or using the Service, you agree to be bound by these Terms.

You must be at least 13 years old to use Travelear. By using the Service, you represent that you meet this age requirement.

You must create an account to use Travelear. Accounts may be created with an email address and password, Apple Sign-In, or Google Sign-In. You are responsible for maintaining the security of your account and for all activity under it. You may not create multiple accounts to abuse free trials, invite codes, or referral programs.

Travelear offers free and premium subscription tiers. Free accounts may listen up to a daily time limit; premium subscriptions remove the daily listening cap and unlock offline downloads, custom playlists, and the sleep timer. Premium subscriptions are billed through the App Store or Google Play. Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period. Cancellation takes effect at the end of the current billing period. Refunds are subject to the policies of the respective app store.

Creators retain full ownership of the audio content they upload. By uploading content, creators grant Travelear a non-exclusive, worldwide, royalty-free license to host, stream, distribute, and display the content within the Service. Creators represent that they own or have obtained all necessary rights for their content and that it does not infringe any third-party rights. Creators earn a share of subscription revenue using a user-centric model. Each subscriber's payment is allocated to the creators they listened to, weighted by listen duration. The base creator revenue share is 70% of the allocated revenue. Payouts are processed via Stripe Connect with a minimum threshold of $1.00 USD.

You agree not to: - Upload content that infringes copyright or other intellectual property rights - Upload harmful, abusive, or inappropriate content - Attempt to circumvent the daily listening cap or other subscription enforcement - Reverse engineer or interfere with the Service - Create multiple accounts to abuse free trials or invite codes - Scrape, harvest, or collect data without authorization - Use the Service for any unlawful purpose

We respect intellectual property rights and comply with the DMCA. To report copyright infringement, contact nick@thetravelear.com with the copyrighted work identification, infringing material details, your contact information, and a good faith statement. We enforce a three-strike policy: first strike is a warning, second strike is account suspension, and third strike is permanent termination.

Users may report content by tapping the flag icon on any track. Reports are reviewed within 48 hours.

You may delete your account at any time from the Profile screen. Deletion is permanent and removes your personal data, profile, playlists, and listening history. We may suspend or terminate your account if you violate these Terms.

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the maximum extent permitted by law, Travelear shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid to us in the twelve months preceding the claim.

We may update these Terms from time to time. Continued use of Travelear after changes constitutes acceptance of the updated Terms.
